Аннотация
В статье представлен анализ процедуры отвода судьи в истории судебного процесса России по Судебным Уставам 1864 года. Проблема отвода судьи в судебном процессе сопряжена с требованиями, предъявляемыми относительно объективности и беспристрастности судьи. Вершиной развития данного института стали нормы, закрепленные именно в Уставах 1864 года. В частности, предполагались, как самоотвод судьи, так и отвод его стороной судебного процесса. Статья представляет интерес для преподавателей и студентов юридической и исторической специальности.
