EXECUTION OF A JUDICIAL ACT ON BRINGING PERSONS CONTROLLING THE DEBTOR TO SUBSIDIARY LIABILITY

Abstract

This article deals with the problems of execution of judicial acts on bringing persons controlling the debtor to subsidiary liability in a bankruptcy case. The conducted research indicate the need for improvement of the enforcement of the law. The author comes to the conclusion that the effectiveness of restoring the violated rights of creditors by bringing to subsidiary responsibility the persons controlling the debtor can be realized by ensuring the enforcement of the relevant judicial act.
